Family and De Facto Law
At Bayani Harvey Lawyers we deal with all areas of relationship law: family law, de facto law and the law relating to same sex couples.
On one level, family law is very complex and a bit of a mystery for most people. On another level, dealing effectively in family law is just about understanding what basic approaches need to be taken for the different aspects of family law, and then applying these principles appropriately.
For example, in relation to parenting issues, there is really only one thing to keep in mind, that is, what is in the best interests of the children. At the end of the day, even if the Court decides, this is what they actually have to determine.
In relation to property division for married, de facto and same sex couples, the only thing that even a Court has to decide is merely what is just and equitable, given the various relevant factors.
Even though these principles are simple to state, it is putting them into practice that is the difficulty.
Bayani Harvey Lawyers approaches relationship law matters on the basis that they can be resolved as quickly, and therefore as efficiently, as possible.
Going to Court should only be a last resort, and instead you should try and have the matter resolved by agreement. How such an agreement is put into practice so that it is legally binding and effective depends on your circumstances and what you want to agree to.
Nowadays, you can have relationship law matters resolved without having any Court involvement at all; for example through a Binding Financial Agreement or a Parenting Plan.
Even if you do have to go to Court, there are still plenty of options available to resolve the matter by consent, as efficiently and cost effective as possible.
